What does the Future Hold for those that abused their power in pursuit of Trump?

The ongoing investigations by AG Barr and the release of more internal info by IG Horowitz will be enlightening. Undoubtedly, it will point to the abuse of power by many in the Obama administration, from the elite echelon down to minions doing their bidding.

But what punishment awaits them? Recall the saying (multiple sources);

From Emerson’s journal in September 1843: “Never strike a king unless you are sure you shall kill him.”

Drawing and quartering may be appropriate but is unlikely to happen. So what can be done? I am no lawyer but there exist a potential legal remedy.

18 U.S. Code § 2384. Seditious conspiracy
If two or more persons in any State or Territory, or in any place subject to the jurisdiction of the United States, conspire to overthrow, put down, or to destroy by force the Government of the United States, or to levy war against them, or to oppose by force the authority thereof, or by force to prevent, hinder, or delay the execution of any law of the United States, or by force to seize, take, or possess any property of the United States contrary to the authority thereof, they shall each be fined under this title or imprisoned not more than twenty years, or both.
(June 25, 1948, ch. 645, 62 Stat. 808; July 24, 1956, ch. 678, § 1, 70 Stat. 623; Pub. L. 103–322, title XXXIII, § 330016(1)(N), Sept. 13, 1994, 108 Stat. 2148.)

This law hinges on the use of force. So what is the definition of force? Is it limited to physical force, I.e. armed insurrection, mobs, use of the military, etc.? Or can force be expanded to include the use of the existing legal system to undermine the President, the use of false documents paid for by the political opposition, the relentless attacks in the media by government officials, etc. Is widespread propaganda and disinformation the use of force? Are the tactics of intimidation and harassment constitute force?

I suspect that many of those involved had serious discussions with attorneys at the outset. It will be interesting to watch and see what charges can be brought.

  1. I interpret "by force" to mean by usurpation, not necessarily by physically violent force. In other words, a seditious conspiracy functions outside established law, using any subversive means to negate the will of the people who elected the public officials the conspiracy is attempting to overthrow.

    If "force" is narrowly defined as physical aggression, then we've seen plenty of that, and it has been sanctioned by Nancy Pelosi and other Dems. Remember, Pelosi praised Antifa. Mobs have harassed Sarah Sanders, other members of the Trump Administration and other conservatives in public restaurants. The dimwit comedienne who made an effigy of POTUS's bloody head, the attack that nearly killed Scalise on a baseball field, the production of Shakespeare's Julius Caesar with the lead role portrayed as Trump assassinated by the Senate, the mob harassment of Pence at the Broadway show "Hamilton," good Lord there is no end to the physical force some have used, all in an attempt to trigger some nut-job somewhere to do the dirty deed.

    But ultimately, isn't "force" the treacherous subversion that Obama and Hillary had Brennan, Comey and Clapper concoct to undermine Trump in the campaign, post-election, and inauguration? If ever there was a seditious conspiracy, it's the Obama-Clinton attempt to usurp the opposition. Let's hope Barr brings them all to justice.

  2. The SCOTUS May have to decide. RBG needs to retire ASAP.
